On Wednesday, Representative Tony Lovasco, R-O’Fallon, introduced HB869, a bill that would allow the treatment of various conditions including post traumatic stress disorder (PTSD) with psilocybin and psilocin derived from mushrooms.
HB869 permits a person twenty-one years of age or older who has been diagnosed with a qualifying serious medical condition including treatment-resistant posttraumatic stress disorder; treatment-resistant depression; or a terminal illness to use “natural medicine,” psilocybin and psilocin, to treat their condition.
Multiple pieces of legislation concerning the legalization of psychedelics for therapeutic uses have come through the legislature in recent years, but none has advanced.
For those approved for treatment, there are no criminal penalties for possession or use.
For those who are not certified for use by a physician, HB869 removes possession of natural medicine from felony possession and defines possession of more than 4 grams of psilocybin or psilocin as a class A misdemeanor, while possession of fewer than four grams would become a class D misdemeanor.
