In a recent guidance document issued on August 31, 2023, the Kentucky Division of Cannabis Regulation (DCR) addresses crucial questions pertaining to the upcoming changes in cannabis item regulations set to take effect on September 1, 2023.

One of the primary concerns raised was whether the Metrc system, a seed-to-sale tracking system used by licensees, would restrict the sale of items aligned with previous item categories and category requirements on September 1, 2023. The DCR responded, stating that it does not anticipate any disruptions to sales for items in alignment with previous item category requirements in Metrc on or after the aforementioned date. Any issues or restrictions experienced by licensees within their tracking systems are likely the result of misconfigurations or actions taken by the licensee, rather than systemic changes. Licensees facing sales restrictions due to item category system errors are encouraged to contact DCR for assistance at CannabisDevelopment@health.mo.gov.

DCR also offered guidance for dispensary licensees, stating that they can continue to sell items from tags aligned with previous item categories until their inventory for those items is depleted. Dispensary licensees are advised not to modify or attempt to align items received from other licensees with the current item category requirements. This includes refraining from renaming or editing items even during repackaging processes. The product’s name as designated by the licensee packaging the product in Metrc will persist throughout the distribution chain.

Additionally, DCR emphasized that licensees repackaging final marijuana products or “Final Packaging” items should select the “use same item” option during repackaging. This action will automatically populate the item’s information from the source tag.

For licensees encountering difficulties in creating items within specific “Final Packaging” categories through their chosen seed-to-sale integrator, the DCR provided a solution. These licensees can manually input items directly into Metrc, and seed-to-sale integrators can subsequently retrieve these entries, ensuring compliance and accurate tracking.

As a general reminder, licensees facing issues with integrated systems may always continue tracking their daily operations directly within the Metrc system.

With this guidance, the Kentucky Division of Cannabis Regulation aims to support a seamless transition for licensees as the new item category requirements come into effect on September 1, 2023.
